The United Nations Commission on International Trade Law (UNCITRAL) is the core legal body within the United Nations system in the field of international trade law. Working Group V (Insolvency) is tasked with considering issues in relation to international and cross-border insolvency law. It is currently working on two projects that aim to harmonise, modernise and unify the law of international trade in the area of insolvency and restructuring. The first project is a model law on the applicable law in insolvency proceedings (APL), which seeks to provide rules for determining the law that governs the commencement, conduct, administration and closure of insolvency proceedings and their effects. The second project is a descriptive, informational and educational text and a toolkit on civil asset tracing and recovery in insolvency proceedings (ATR), which seeks to consolidate and expand on the existing UNCITRAL insolvency framework and to present tools that enable urgent ATR measures across borders.


IWIRC Europe will host a panel on 30 September 2024 to discuss the progress and implications of these projects with four speakers who are delegates to the UNCITRAL Working Group V and represent different international legal and procedural systems. The speakers are:

  • Louise Brittain, Head of Contentious Insolvency at Azets in the UK and a leading practitioner in civil asset tracing and recovery;
  • Debby Lim, Deputy head of Restructuring, Insolvency and Bankruptcy at Dentons Rodyk Singapore, who specialises in all areas of contentious insolvency, asset recovery work (including major commercial disputes), fraud and investigations;
  • Olya Antle, a US restructuring lawyer at Cooley LLP, who has extensive experience in cross-border insolvency and restructuring matters; and
  • Kathlene Burke, an Irish restructuring lawyer at Maples & Calder in Dublin, who has been involved in complex and contentious in-court schemes and reorganisation cases across Europe, the US and various other jurisdictions.


The panel will provide an overview of the main features and challenges of the APL and ATR projects, as well as the potential benefits and drawbacks of their adoption and implementation in different jurisdictions. The panel will also share their insights and perspectives on the future of insolvency and restructuring law at the global level.
