Since the launch of the European Pillar of Social Rights in 2017, there has been renewed momentum behind the Social Europe agenda. At the centre of this has been the European Directive on Adequate Minimum Wages, designed to ensure that statutory minimum wages across the EU are adequate, and to strengthen collective bargaining.This momentum is now at risk.Denmark has brought a case before the European Court of Justice, arguing that the EU lacks the legal competence to legislate in this area. In a significant development, Advocate General Nicholas Emiliou has recommended that the Court annul the directive.A new report by TASC Senior Economist Oisín Gilmore examines the Advocate General’s opinion, the directive itself, and what’s at stake for the broader Social Europe agenda.
